Terms of Service

1. Provider and scope

These terms and conditions apply to the use of the website (elyvite.com) and the application (app.elyvite.com) of Flowprimo LLC, a Limited Liability Company under the law of the State of Delaware, USA, Flowprimo LLC, c/o Legalinc Corporate Services Inc., 131 Continental Dr, Suite 305, Newark, DE 19713, USA (“Elyvite”, “we”). By using the service you agree to these terms.

Billing through a Merchant of Record: Paid access is distributed worldwide through Lemon Squeezy (Sold through Link, LLC) as Merchant of Record. For the purchase transaction (payment, invoice, taxes, refund) Lemon Squeezy is the seller in the legal sense; its terms apply in addition. The service itself is provided by us, Flowprimo LLC.

2. Description of services

Elyvite is a research platform for health professionals. It gathers and curates the consensus of experts and compares it with current studies and web sources, with a source for every claim. You can research your own questions, retrieve content and organise your research into categories and projects. The scope of features and availability may evolve.

3. Registration and account

To use the service you create an account. In doing so you provide truthful information, keep your credentials confidential and are responsible for activities under your account. The account is not transferable.

4. Conclusion of contract, prices and payment

The paid plan costs €39 per month (tax shown by Lemon Squeezy). There is one plan with the full range of features.
The contract for access is concluded upon completion of the order process at Lemon Squeezy.
Payment, VAT and invoicing are handled by Lemon Squeezy as Merchant of Record.
There is no free trial period.

5. Term, automatic renewal and cancellation

The subscription runs monthly and renews automatically for one further month unless cancelled.
You may cancel monthly, with effect from the end of the current billing period. Cancellation is possible at any time via your account or via Lemon Squeezy.

6. Right of withdrawal for consumers

Consumers have a statutory right of withdrawal. The full withdrawal instructions and the model withdrawal form are set out in Annex A.

Since access is provided immediately, we ask you to expressly consent to us beginning performance before the withdrawal period expires, and to acknowledge that your right of withdrawal lapses upon complete performance of the contract.

7. Refunds

Refunds are processed through Lemon Squeezy. Statutory consumer rights remain unaffected.

8. No medical advice

Elyvite is not medical advice. All content serves exclusively informational and research purposes and reflects expert opinions, research findings and structured data. It does not replace professional medical advice, diagnosis or treatment. If you have questions about a medical condition, always consult a qualified professional.

9. Rules of use

You undertake in particular:

not to enter personal data of your clients or health data relating to identifiable individuals. Research in general terms. Professional and legal responsibility in your advice remains with you.
not to use the service for unlawful purposes,
not to disrupt its operation and not to circumvent security measures,
not to use automated systems (bots, scrapers) without our permission,
not to systematically reproduce or resell content,
to comply with applicable law.

10. AI-supported content and no warranty of accuracy

Elyvite prepares content with the help of AI. We gather and curate; we show consensus and disagreement with sources. We do not guarantee that experts or sources are correct, or that results are complete or up to date. The assessment and the decision are yours. How we use AI is set out on our AI transparency page.

11. Elyvites (research allowance)

Research performed by the AI assistants is charged in “Elyvites”, a monthly allowance included in the plan (all model costs included). Elyvites have no cash value and are not redeemable for cash.

12. Intellectual property

All rights in the platform, the software, the design and the data compilations belong to Flowprimo LLC or its licensors. Expert content prepared by Elyvite is attributed to the original authors and structured for research and educational purposes. Your own entries remain your content; you grant us the right to process them in order to provide the service.

13. Availability and changes to the service

We strive for high availability but do not owe uninterrupted availability. We may further develop the service, change it or adapt features, provided this is reasonable for you.

14. Warranty and liability

The service is provided with due care. To the extent permitted by law, we are not liable for indirect, incidental or consequential damages, loss of profit or loss of data.

We are liable without limitation for damages arising from injury to life, body or health, from intent or gross negligence, and as required by mandatory law.

15. Blocking and termination by us

In the event of significant breaches of these terms and conditions, we may block the account or terminate the contract for cause. Fees already paid will be refunded pro rata to the extent required by law.

16. Applicable law and place of jurisdiction

The law of the Federal Republic of Germany applies. Mandatory consumer protection provisions of the state in which the consumer has their habitual residence remain unaffected.

17. Consumer dispute resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

18. Changes to these terms and conditions

We may amend these terms and conditions. We will give timely notice of material changes; if you continue to use the service after they take effect, they are deemed accepted to the extent permitted. In the event of unfavourable changes you have a right of cancellation.

19. Final provisions

Should any provision be invalid, the remainder of the contract remains effective. It is replaced by the statutory provision.

21. Annex A — Withdrawal instructions (model)

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day of conclusion of the contract.

Exercising the right of withdrawal

To exercise your right of withdrawal, you must inform us (Flowprimo LLC, c/o Legalinc Corporate Services Inc., 131 Continental Dr, Suite 305, Newark, DE 19713, USA, legal@elyvite.com) of your decision by means of an unequivocal statement. You may use the model withdrawal form for this purpose, but this is not mandatory.

Effects of withdrawal

If you withdraw from this contract, we will reimburse all payments received without undue delay. If you requested that performance begin during the withdrawal period, you owe us a proportionate amount for the service provided up to the withdrawal. For a contract for digital content or services, the right of withdrawal lapses once we have begun performance after you expressly consented and acknowledged that you lose your right of withdrawal.
